One of the significant objectives of Drugs & Cosmetics Act-1940 is to regulate the sale of drugs & under direct control of Commissioner FDCA, Gujarat State; it is being taken care of by various Circle Offices situated at district places of Gujarat.
As per the provisions of the Act, for the sale of Allopathic & Homeopathic drugs, every firm has to obtain necessary licences from the Licensing Authority & Assistant Commissioner of the respective Circle Office. For the sale of Ayurvedic drugs no licence is required.
At the end of March-2002, In Gujarat, more than ________ firms are holding licences for the retail sale of allopathic drugs, ________ firms are holding licences for the wholesale of allopathic drugs & ___________ firms are holding licensee for the sale of Homeopathic drugs.
The licensee firms are periodically inspected by the Drugs Inspectors to ascertain that the provisions of Drugs & Cosmetics Act-1940 and Drugs & Cosmetics Rule-1945 are being observed. If any contravention found during the inspections, after following necessary procedure, the Licensing Authority & Assistant Commissioner of the respective Circle takes appropriate actions against the firm. The actions may vary from issuing warning, suspension or cancellation of licences to filing a complaint in the Court of Law depending upon the nature of the contraventions. Similarly, inspection under Drugs Price Control Order-1995 and Drugs & Magic Remedies (Objectionable Advertisements) Act-1954 are carried out by Drugs Inspectors.
Sampling of various drugs & cosmetics from the licensee firms is carried out by Drugs Inspectors to ascertain the quality of the drugs & cosmetics.
